Regulations, the MOTTO of a good stay.

§1 SUBJECT OF THE REGULATIONS

These regulations, hereinafter referred to as the “Regulations,” apply within the hotel property Motto Gdańsk, located in Gdańsk (ul. Długie Ogrody 43), and apply to all persons present on its premises.

In this document, the person renting rooms is referred to as the “Guest,” and the property Motto Gdańsk as the “Property.” A front desk employee is responsible for Guest care.

The Regulations specify the rules for using the Property’s services, Guests’ obligations, and govern the conditions of stay on the premises. They constitute an integral part of the short-term rental agreement, which is deemed concluded at the moment of making a reservation, paying a deposit or the full amount for the stay, or signing the registration card by the Guest. Performing any of the above actions by the Guest constitutes confirmation of having read the Regulations, their acceptance, and an undertaking to comply with their provisions.

§2 HOTEL DAY

Rooms at the Property are rented on a daily basis.

The hotel day begins at 14:00 and ends at 11:00 the following day from October through April. In the remaining months, the start of the hotel day moves to 15:00, while the end time remains the same.

If the Guest has not specified the length of stay when concluding the rental agreement, it is assumed the room has been rented for one hotel day.

Requests to extend the hotel day should be reported by the Guest to the front desk no later than 10:00 on the day the current hotel day ends. The decision on the possibility of extending the stay rests with the front desk staff and may depend on room availability.

If the room is occupied past the designated checkout time without prior arrangement to extend the hotel day, an additional fee of PLN 50 will be charged for each commenced hour of overstay. If the time of the new hotel day is exceeded, the cost of an additional night will be charged according to the current price list.

Check-in before the official start of the hotel day is possible only by prior arrangement with the front desk and with the front desk employee’s consent. A surcharge of PLN 100 applies for check-in before 11:00.

If the room is not vacated on time and this disrupts the check-in and check-out schedule, the Property reserves the right to pack the Guest’s belongings and store them if the Guest is not in the room and refuses to check out. This action is intended to prepare the room for incoming guests. The Guest’s belongings will be stored in a secure location until collected by their owner. If such action is necessary, the Property reserves the right to impose a contractual penalty of PLN 500 for disrupting the schedule and the Property’s operations.

§3 RESERVATION AND CHECK-IN

Room reservations can be made online, by phone, or in person at the Property.

After making a reservation, the Guest will receive an email confirmation of the reservation terms, which also includes information on paying a deposit amounting to 30% of the planned stay value. For one-night reservations, the deposit is 100% of the stay price.

If the deposit is not paid by the specified deadline, the Property reserves the right to cancel the reservation and make the room available to others. A deposit paid after the deadline will be refunded to the Guest within 14 business days from the date the reservation was cancelled by the Property.

Once the deposit has been credited to the Property’s bank account, the Guest receives a guaranteed reservation agreement by email.

If the Guest cancels a guaranteed reservation more than 30 days prior to the planned arrival date, the Property will refund the deposit in the form of a voucher.

If the Guest cancels a guaranteed reservation 29–14 days before the planned arrival date, the Property will refund 50% of the deposit in the form of a voucher.

If the Guest cancels the reservation less than 14 days before the planned arrival date, the Property will not refund the deposit, and the Guest will be charged the full cost of the reservation. In special, justified cases, the Guest may be charged the cost of the first night of the planned stay.

Cancellation of a non-refundable reservation does not result in the return of the deposit, regardless of the cancellation date.

In the case of changing reservation dates, converting the deposit into a voucher, or cancelling previously rescheduled reservations, deposit refunds will be considered on a case-by-case basis.

For last-minute reservations made shortly before arrival, electronic correspondence from the Guest will be treated as an order and will be subject to the standard cancellation terms. The Property reserves the right to pre-authorise the Guest’s payment card or charge 30% of the stay value, treating this payment as a deposit.

Check-in requires the Guest to present a photo ID to the front desk employee and to sign the registration card.

The Guest is not entitled to transfer the rented room to third parties, even if the paid period has not yet expired.

Unregistered persons may stay in the Guest’s room as visitors between 08:00 and 22:00. For breaching this provision, the Property will impose a contractual penalty of PLN 300 on the Guest and will also require payment for the stay of the additional persons according to the applicable daily price list.

The Property may refuse to accept a Guest who, during a previous stay, violated the Regulations by causing damage to the Property’s or other Guests’ possessions, employees, or other persons, or disturbed other Guests’ peace or the Property’s operations.

The Property reserves the right to refuse a Guest without stating a reason.

The Property reserves the right to pre-authorise the Guest’s payment card or to take payment for the entire stay at check-in.

Any additional charges arising during the stay must be settled by the Guest no later than on the day of departure.

If the Guest leaves the Property earlier than stated in the guaranteed reservation agreement, the difference in the cost of the stay is non-refundable.

Failure of the Guest to arrive at the Property on the date specified in the guaranteed reservation agreement results in no refund of the deposit.

If the Guest resigns from a purchased breakfast option, the Property will not refund its value.

Stays with pets are permitted only with the Property’s explicit consent. In such cases, an additional fee of PLN 80 per day applies.

§4 SERVICES

If there are any reservations regarding the quality of services provided, please report them to the front desk immediately so the Property’s staff can respond promptly.

The Property undertakes to ensure conditions for the Guest’s full and unimpeded rest, the safety of the stay, protection of personal data, professional and courteous service in all provided services, to carry out necessary repairs of equipment during the Guest’s absence or in their presence with consent, and to change the room subject to availability, or provide other compensation for inconveniences related to defects in the room that cannot be removed.

At the Guest’s request, the Property provides the following services free of charge: information related to the stay and travel, lending an iron and ironing board for use in designated areas.

At the Guest’s request, the Property provides the following paid services: room service, scanning and printing documents, linen or towel exchange, additional cleaning.

The Property offers parking spaces on private grounds behind the building, for an additional fee.

A parking space reservation must be requested at the front desk no later than on the day of check-in. Confirmation of the parking space reservation is an email sent to the Guest by the Property’s staff.

§5 PROPERTY’S LIABILITY

The Property is liable for loss of or damage to items brought in by persons using its services, to the extent specified by Articles 846–849 of the Polish Civil Code, unless the parties agree otherwise.

The Guest should immediately report any damage to the front desk.

The Property is not liable for theft of money, securities, valuables, or items of scientific or artistic value unless they have been deposited in the safe.

In the event of loss of the above items, compensation shall not exceed the amount specified in the Regulation of the Minister of Justice of 24 July 1998 on limiting the liability of persons conducting hotel or similar activities (Journal of Laws 1998 No. 117, item 756, as amended).

The Property reserves the right to refuse to accept into deposit items of high value, substantial sums of money, items posing a safety risk, and oversized items that cannot be placed in the safe.

§6 GUEST’S LIABILITY

In case of fire, proceed toward the exit according to the evacuation signs, and after leaving the building keep a safe distance and call the fire brigade by dialing 112.

Children under 12 must remain on the Property’s premises under the constant care of their legal guardians, who bear full financial responsibility for any damage caused by the children.

The Guest bears full financial responsibility for any damage or destruction of the Property’s furnishings and technical equipment caused by the Guest or persons visiting them. An indicative price list of repair costs for possible damage is an annex to these Regulations.

The Property reserves the right to charge the Guest’s payment card for damages found after departure. If there are no card details, the Property has the right to seek financial compensation from the Guest to cover the costs of repairing the damage and lost revenue if the damage required the room to be taken out of service. The value of lost revenue will be calculated according to the current price list for that room for the period it was unavailable for sale.

If any defects or damage occur in the room, the Guest is obliged to immediately inform the front desk.

If the Guest violates the Regulations, the Property may refuse further service. The Guest must immediately settle the charges for the stay and any damages and leave the Property.

For safety reasons, when leaving the room the Guest is obliged to close the windows, unplug electrical devices, turn off taps, and lock the door.

The Property has a statutory lien on items brought by the Guest into the Property in the event of delayed payment for the services provided.

If Property staff must come to the Property outside front desk hours, especially at night, due to the Guest’s actions, the Property has the right to charge an additional fee of PLN 150. An additional fee will also be charged if the Guest loses the room key or electronic access card to the room or the Property.

§7 LOST-AND-FOUND ITEMS

Personal belongings left inadvertently in the room by a departing Guest will be sent at the Guest’s expense to the address provided.

If the Guest does not provide instructions regarding the return of left items, the Property will store them at the owner’s expense for three months, after which they become the Property’s possession. Food items will be stored for 24 hours.

§8 QUIET HOURS

Quiet hours are in effect from 21:00 to 08:00 the following day.

The behaviour of Guests and persons using the Property’s services should not disturb the peaceful stay of other Guests. The Property has the right to refuse further service to persons violating this rule and may remove such a Guest from the Property without any compensation for the shortened stay.

§9 FINAL PROVISIONS

For fire safety reasons, the use of open flames in rooms, such as candles, and the use of electrical devices that are not part of the room’s equipment, such as electric irons, is prohibited.

The Property is entirely non-smoking. If this ban is violated, the Guest will be charged a standard room refreshing fee of PLN 750. If the fire alarm system is triggered and the fire brigade arrives due to a smoking ban violation, the Guest will be charged an additional PLN 750.

It is strictly forbidden to possess or use intoxicants prohibited by law. If this ban is violated, the Property will notify the Police, and the Guest must immediately leave the Property without any right to a refund for the shortened stay.

Dangerous items, such as weapons, ammunition, flammable materials, pyrotechnics, etc., may not be stored in the rooms.

Guests’ personal data are processed for the purpose of providing services by the Property. The personal data controller is PHU OMEGA Dagmara Szamborska, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. Full information on personal data processing is available in an annex to these Regulations, on this website, and at the front desk.

Door-to-door canvassing and peddling on the Property’s premises are prohibited.

Excessive noise, emitting unpleasant odours, and performing other activities that may disturb, harm, or irritate other Guests are prohibited.

Guests may not alter the furnishing and arrangement of rooms, except for minor repositioning of furniture and equipment without affecting their functionality and safety.

The Property’s front desk operates during summer season (from 1 July to 15 September) from 09:00 to 17:00, and outside the summer season (from 16 September to 30 June) from 09:00 to 15:00.

The court competent to resolve any disputes between the Guest and the Property is the local court with jurisdiction over Motto Gdańsk’s registered seat in Gdańsk.

Consent to stay at the Property is equivalent to acceptance of these Regulations.

ANNEX NO. 1 TO THE REGULATIONS

§1. LIST OF REPAIR COSTS FOR DAMAGE AND DESTRUCTION AT THE PROPERTY

For damage or destruction of bathroom fixtures and fittings, such as a washbasin, toilet bowl, shower enclosure, mirror, or ceramic tiles, the compensation amount is determined individually after inspection and preparation of a damage report. Compensation is calculated based on current material price lists and labour rates.

If rooms or corridors must be repainted due to violation of the Property’s no-smoking policy or permanent damage to wall surfaces (e.g., painting, scratches, and other mechanical damage), compensation is PLN 594.00.

For damage or soaking of a bed, compensation is PLN 495.00.

Permanent damage to furniture and room/property equipment is subject to compensation equal to the purchase price of the damaged item, with an additional 10% surcharge over the purchase price.

Compensation for permanent damage to building joinery or its fittings is determined individually, taking into account the value of materials and installation costs.

Compensation for destruction of a bed sheet is PLN 44.00.

Destruction of a duvet cover is subject to compensation of PLN 88.00.

For destruction of a pillowcase, compensation is PLN 27.50.

For destruction of a carpet, compensation is PLN 275.00.

Compensation for destruction of a large towel is PLN 66.00, and for a small towel PLN 44.00.

For destruction of a bedspread, compensation is PLN 99.00.

Destruction of a stool or a deck chair is subject to compensation of PLN 110.00 and PLN 220.00 respectively.

For loss of an electronic card or room key, compensation is PLN 385.00.

The cost of preparing a damage or destruction report, including conducting the inspection, is PLN 110.00.

ANNEX NO. 2 TO THE REGULATIONS

§1. RULES FOR PROCESSING GUESTS’ PERSONAL DATA BY THE PROPERTY

The controller of personal data is PH OMEGA Dagmara Szamborska, NIP: 5842032374, responsible for processing data in accordance with the GDPR and the Polish Personal Data Protection Act.

The purpose of processing personal data is to perform the hotel services agreement, including handling reservations, guest check-in and check-out, as well as for legal purposes, including the pursuit and defence of claims, for tax purposes, and to improve service quality.

Personal data may be processed for marketing purposes if the Guest gives consent. Such consent may be withdrawn at any time.

CCTV monitoring at the Property is conducted to ensure the safety of Guests and staff, and footage is stored for up to 30 days, unless a longer retention period is required for valid legal reasons.

The legal basis for processing personal data is the hotel services agreement and the Guest’s consent in the case of marketing activities.

Personal data may be shared with external entities cooperating with the Property in the provision of services, including IT providers, law firms, transport companies, and accounting firms, always in compliance with data protection requirements.

Guests have the right to access their data, rectify, erase, or restrict processing, as well as the right to object to processing and the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO), the supervisory authority for personal data protection.

Providing personal data is necessary to conclude and perform the hotel services agreement. Failure to provide such data may make it impossible to perform the agreement.

The Property does not make automated decisions, including profiling, based on personal data.

ANNEX NO. 3 TO THE REGULATIONS

§1. VOUCHER PURCHASE TERMS AND CONDITIONS

A voucher is issued as a unique, multi-character code generated electronically.

The Property undertakes to deliver the Voucher electronically to the Purchaser and to accept it as a means of payment at Motto Gdańsk.

The Purchaser is obliged to pay for the Voucher in the amount corresponding to the value indicated at purchase on this website.

The Voucher entitles the holder to use services exclusively at Motto Gdańsk.

The Voucher is non-refundable and cannot be exchanged for cash.

Payment by Voucher must be made in a single transaction and may apply to only one reservation.

The Property is not responsible for Vouchers that are lost or damaged after being sent to the Purchaser.

The Purchaser and the User have no claims against the Property in case of loss or destruction of the Voucher.

The Voucher’s validity period is specified in the purchase confirmation sent by email. The Voucher’s validity cannot be extended. Vouchers may be subject to availability limits, especially during peak periods such as long weekends, Christmas, New Year’s Eve, New Year’s Day, or Easter.

No change is given if the value of the services or goods purchased is lower than the Voucher’s value.

The Property reserves the right to refuse to redeem a Voucher after its expiry or if its code is illegible or cannot be verified.

A VAT invoice is issued at the Purchaser’s explicit request when buying the Voucher.

By accepting the Voucher, the Purchaser/User confirms having read these Terms and Conditions, accepts their provisions, and undertakes to comply with them.

Matters not regulated herein are governed by the relevant provisions of the Civil Code.

The Voucher is treated as a means of payment in the form of a gift certificate. It should be entered in the appropriate field of the reservation form when making a reservation on this website.
